Exemption for Texas Veteran Dependents

 

Hazlewood Disability Purpose:   The Hazlewood Disability Benefit helps children of eligible veterans pay for college. It provides up to 150 credit hours of tuition and required fee coverage at public colleges and universities in Texas. This benefit is for children of veterans who are rated 100% Totally and Permanently Disabled by the U.S. Department of Veterans Affairs (VA).

To qualify for the Hazlewood Disability Benefit, a spouse or child must meet all of the following requirements:

  • Be classified as a Texas resident by the university.; (40 TAC §461.70)
  • Be the veteran’s biological child, stepchild, adopted child, or have been claimed as the veteran’s dependent on a current or previous tax return.;
  • Be 25 years old or younger on the first day of the semester for which the benefit is requested.
    • An extension may be granted if the student has a qualifying illness or serious medical condition
  • Not be receiving federal Veterans' education benefits that pay for tuition and fees only (such as Chapter 33), unless those benefits do not exceed the value of the Hazlewood benefit for the same semester. (40 TAC §461.70) & (40 TAC §461.90)
  • Not be in default on any student loan made or guaranteed by the State of Texas.
  • Enroll in courses that receive state tax support.
  • Meet the school’s satisfactory academic progress requirements, including:
    • Maintaining the required GPA requirement determined by Financial Aid's policy.
    • As not be considered to have attempted an excessive number of credit hours.

Meet the GPA requirement of the institution’s satisfactory academic progress policy in a degree or certificate program as determined by the institution’s financial aid policy and, as an undergraduate student, not be considered to have attempted an excessive amount of credit hours.

*Eligible Veterans may assign or transfer unused hours of exemption eligibility to a child under certain conditions as drawn from the Hazlewood Act Statute and 40 Texas Administrative Code §461. Recipients will receive an exemption for the number of degree certified hours reported by the institution for that term or semester. Maximum degree certified hours awarded to the recipient will be dependent upon the degree or certificate program in which the student is enrolled for that term or semester and shall be consistent with the program length as defined within the school catalog as approved by the regional accreditation commission. (40 TAC §461.30If a child to whom hours have been delegated fails to use all of the assigned hours, a Veteran may re-assign the unused hours that are available to another child.
